Welcome to Fly Habyt. These Terms & Conditions govern your use of the Fly Habyt website and our travel-related services, including tour packages, customised itineraries, accommodation arrangements, transportation, activities, and other travel services.

By accessing our website or booking any service with Fly Habyt, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

1. About Fly Habyt

Fly Habyt provides travel planning and travel-related services, including customised holidays, tour packages, accommodation, transportation, activities, and travel experiences in Bali, Indonesia, and other destinations.

The specific services included in your booking will depend on the itinerary, quotation, booking confirmation, or travel agreement provided to you.

2. Booking and Confirmation

All bookings are subject to availability and confirmation by Fly Habyt and/or the relevant travel service provider.

A booking is considered confirmed only after:

  • We have received the required booking information from you;
  • The applicable payment or deposit has been received; and
  • Fly Habyt has issued a written booking confirmation.

Requests made through our website, WhatsApp, email, or other communication channels do not automatically constitute a confirmed booking.

3. Pricing and Payment

All prices will be communicated in the applicable quotation, package information, or booking confirmation.

Prices may vary depending on travel dates, availability, accommodation category, transportation, activities, exchange rates, taxes, government fees, and other applicable charges.

Unless otherwise stated:

  • A deposit or full payment may be required to confirm your booking.
  • The payment schedule will be stated in your quotation or booking confirmation.
  • Any outstanding balance must be paid by the deadline specified by Fly Habyt.
  • Failure to make payment on time may result in cancellation of the booking and applicable cancellation charges.

Fly Habyt reserves the right to correct pricing errors or inaccuracies and will inform customers as soon as reasonably possible.

4. Changes to Your Booking

We understand that travel plans may change. Requests to modify a booking, including travel dates, accommodation, activities, transportation, or the number of travellers, are subject to availability and may incur additional charges.

Any changes must be requested in writing and will only be effective once confirmed by Fly Habyt.

Certain suppliers may apply their own modification or amendment fees, which will be passed on to the customer where applicable.

5. Cancellation and Refunds

Cancellation terms depend on the services included in your booking and the policies of the relevant suppliers.

Any cancellation must be submitted in writing.

Cancellation charges may apply based on:

  • The date the cancellation request is received;
  • The type of service booked;
  • Supplier cancellation policies;
  • Non-refundable bookings or services; and
  • Any costs already incurred by Fly Habyt on your behalf.

Where a refund is applicable, the amount refunded will be calculated after deducting any applicable cancellation fees, supplier charges, transaction fees, or other non-refundable costs.

Please refer to your booking confirmation or quotation for the specific cancellation and refund conditions applicable to your trip.

6. Travel Documents and Entry Requirements

Travellers are responsible for ensuring that they have valid travel documents, including passports, visas, permits, health certificates, and other documents required for their journey.

Passport and visa requirements vary depending on nationality, destination, and travel circumstances.

Fly Habyt may provide general travel information, but travellers remain responsible for checking the latest requirements with the relevant government authorities, embassies, consulates, airlines, and immigration authorities.

Fly Habyt is not responsible for losses resulting from a traveller’s failure to obtain the required travel documents or meet entry requirements.

7. Travel Insurance

We strongly recommend that all travellers obtain appropriate travel insurance before departure.

Travel insurance should, where appropriate, cover cancellation, medical expenses, emergency assistance, baggage loss or delay, personal liability, travel interruption, and other risks associated with international or domestic travel.

Unless expressly stated in your booking, travel insurance is not included in our travel packages.

8. Third-Party Suppliers

Some services arranged by Fly Habyt may be provided by independent third parties, including hotels, airlines, transportation companies, restaurants, tour operators, guides, activity providers, and other suppliers.

These services are subject to the terms and conditions of the relevant supplier.

While Fly Habyt takes reasonable care in selecting and coordinating suppliers, we are not the direct provider of every service included in your itinerary.

Supplier policies may apply to cancellations, changes, refunds, delays, service limitations, and other matters.

9. Itinerary Changes

Travel itineraries may occasionally need to be changed due to circumstances beyond our reasonable control, including weather conditions, natural disasters, traffic, government restrictions, operational issues, safety concerns, supplier changes, or other unforeseen circumstances.

Fly Habyt will make reasonable efforts to provide suitable alternatives where possible.

Changes to an itinerary do not automatically entitle the traveller to a refund unless required under the applicable booking terms or relevant law.

10. Delays and Disruptions

Fly Habyt is not responsible for delays, cancellations, missed connections, or disruptions caused by airlines, transportation providers, weather, natural events, government actions, strikes, traffic, technical issues, or other circumstances beyond our reasonable control.

Where possible, our team will assist travellers in coordinating alternative arrangements.

Any additional costs resulting from such disruptions may be payable by the traveller unless otherwise agreed or covered by the applicable supplier or insurance policy.

11. Traveller Responsibilities

Travellers are expected to:

  • Provide accurate and complete information when making a booking;
  • Follow applicable laws and regulations;
  • Follow instructions provided by guides, drivers, hotels, activity providers, and other service providers;
  • Respect local customs, communities, properties, and the environment;
  • Behave responsibly and safely throughout the trip; and
  • Arrive at designated meeting points on time.

Fly Habyt reserves the right to refuse or terminate a service if a traveller’s behaviour creates a safety risk, causes significant disruption, damages property, or violates applicable laws or supplier policies.

12. Health and Safety

Travellers are responsible for assessing whether they are physically and medically able to participate in the activities included in their itinerary.

Certain activities may involve inherent risks, including water activities, hiking, diving, boating, cycling, adventure activities, or other physical activities.

Travellers must inform Fly Habyt of any relevant requirements or limitations that may affect the safe delivery of the trip.

Where necessary, Fly Habyt may recommend that a traveller obtain medical advice before participating in particular activities.

13. Personal Belongings

Travellers are responsible for their personal belongings, valuables, passports, electronic devices, luggage, and other possessions during the trip.

Fly Habyt is not responsible for loss, theft, damage, or delay of personal belongings except where liability cannot legally be excluded.

Travellers are encouraged to use hotel safes and maintain appropriate travel insurance.

14. Website Information

We make reasonable efforts to ensure that information published on our website is accurate and up to date.

However, descriptions, photographs, prices, itineraries, availability, and other information may change without notice.

Images shown on the website are intended to provide a general representation of destinations, hotels, activities, and experiences. Actual conditions, room configurations, facilities, views, and services may vary.

15. Website Use

You agree to use the Fly Habyt website only for lawful purposes.

You must not:

  • Use the website for fraudulent or unlawful activities;
  • Attempt to gain unauthorised access to the website or its systems;
  • Copy, reproduce, distribute, or commercially exploit website content without permission;
  • Introduce malicious software or harmful code; or
  • Interfere with the security or operation of the website.

16. Intellectual Property

Unless otherwise stated, all content on the Fly Habyt website, including text, logos, graphics, photographs, designs, trademarks, videos, and other materials, is owned by or licensed to Fly Habyt.

You may not reproduce, modify, distribute, publish, or commercially use our content without prior written permission.

17. Force Majeure

Fly Habyt will not be liable for failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

  • Natural disasters;
  • Severe weather;
  • Earthquakes, volcanic activity, or other natural events;
  • Pandemics or public health emergencies;
  • War, terrorism, or civil unrest;
  • Government restrictions or regulations;
  • Strikes or industrial action;
  • Transportation disruptions;
  • Infrastructure failures; or
  • Other events that could not reasonably have been anticipated or prevented.

18. Limitation of Liability

To the extent permitted by applicable law, Fly Habyt shall not be liable for indirect, incidental, consequential, or unforeseeable losses arising from the use of our website or travel services.

Our liability, where applicable, will be subject to the terms of the relevant booking, supplier agreements, and applicable law.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited.

19. Privacy

Any personal information provided to Fly Habyt will be handled in accordance with our Privacy Policy.

By making a booking, you acknowledge that certain personal information may need to be shared with relevant suppliers, including hotels, transportation providers, airlines, activity providers, guides, or government authorities where necessary to provide the requested services.

20. Complaints

If you experience an issue during your trip, please contact Fly Habyt as soon as reasonably possible so that we have an opportunity to assist and resolve the matter.

Where possible, complaints should be reported during the trip rather than after departure, particularly where immediate action may resolve the issue.

Formal complaints should be submitted in writing within a reasonable period after the completion of the relevant service.

21. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia, unless otherwise required by applicable law.

Any dispute arising from these Terms & Conditions or our services shall be handled in accordance with applicable Indonesian law.

22. Changes to These Terms

Fly Habyt may update or amend these Terms & Conditions from time to time.

The latest version will be published on our website with the applicable “Last Updated” date.

Your continued use of the website or booking of services after an updated version has been published constitutes acceptance of the revised Terms & Conditions, to the extent permitted by applicable law.
